Legal Question in Family Law in New Jersey

Is a divorce agreement still binding when the parties move out of state?

My exhusband stopped paying his court ordered 50%

of childcare and 75% of his son's unpaid medical

bills a year ago. He said that since he no longer

lives in NJ, there is no jurisdiction over him and

he does not have to pay it. He says in Phila, child

care is the same as CS and is included even though I

only receive $80 per week. (He is a physician).

I can not make ends meet and am considering bankruptcy

I am at my wit's end financially. PA has jusisdiction

over CS at this point.

Re: Is a divorce agreement still binding when the parties move out of state?

Not only is the divorce agreement binding even when one party moves out of state, the original state retains jurisdiction as long as the child still lives there. You need to contact an attorney immediately to enforce your rights and get your ex to pay what he is required to pay under the agreement. He may also be required to pay your legal fees for violating the agreement. If you want me to help you, feel free to call me at 856-546-8010.
