Divorce from Bed and Board
A friend of mine thought he was getting a divorce and ended up with a divorce from bed and board instead. His own lawyer colluded with his wife's lawyer and misled him: he thought he was divorced; he only learned at tax time that he was legally separated. I read the agreement, and it is horribly unfair to him. His wife was given all community property and he works two jobs just to survive at a poverty level; nearly all of his money goes toward alimony and child support. His wife was abusive to him throughout the marriage. She insisted that he leave the house when she learned he no longer loved her because of the constant abuse. He wanted to stay to care for and protect the children. This man was emotionally devastated and taken advantage of not only by his spouse but by his own lawyer. I told him he may be due some sort of reparations from the original lawyer, if he can get a new lawyer to review his options. Who can he turn to, and what are his rights?

Custody of children can always be addressed. The Court's main concern is attaining what is in the
best interest of the children.
A divorce seems a simple matter at this point; all of the financial issues have been resolved.
As for his lawyer's malpractice more information is required to address that question.
