divorce / car payments

My wife and I just got divorced. When we separated 18 months ago, we had a PT cruiser. We both agreed that she would have the car and be totally responsible for all payments of the car. The car was in both of our names.

About 7 months ago, she totaled the car. The financial co. wants its payments and is calling both of us. Is there a way that I can get my name off the title or by adding that we agree that she is responsible for payments to the divorce agreement and sending it to the financial co. that they would stop bothering me or is there no way out for me?

You divorce agreement is not binding on third parties. If they sue you for the money you will have to sue her to pay for you.

you got divorced and you probably had no lawyer representing you. an attorney should have put in something to cover your obligation to the finance company to pay for the car.

You need a lawyer. no chat is going to solve this small but nasty mess. Go get a lawyer.

it sounds like the car was not worth as much as you owed on it, and the insurance company's payment was not enough to cover the debt. when you bought the car, you said, you promised that you (and your exwife promised) to pay for the car loan. no agreement in divorce makes the finance company have to let you go. you still owe. remember, i am basing this only on what you said.

I can't tell from your question whether this was a formal agreement or an oral agreement.
