Legal Question in Family Law in New Jersey

divorce and car repo

I am getting a divorce not papers have been signed. My husband is driving a car that is a part of the settlement. It is in my name and it is time to renew the insurance and registration. I will not sign it over to him until the divorce is settle but he is refusing to pay for the renewals. Can I take the car and park it in the gargage and turn in the plates? He will drive around without insurance. If I dont take it will I be liable if he gets pulled over?

I do not understand why you would resist doing something that you have apparently agreed to. If an Agreement has been reached and you are just awaiting the signing of the documents (which you both have also agreed to), it seems silly to me not to begin the process of doing what you already agreed to, especially when the possibility of an uninsured car is apparent.

You could be sued for an accident which he has with your car while it is uninsured.
