Once a divorce is filed, can the parent who has legal custody, move out of state with the children?

Only if the other side consent or a court grants the motion to move out of state. I strongly suggest you consult an attorney before doing anything due to the complexity of these motions.

Re: divorce - with children

To leave the state permanently with a couple's children the parent who leaves needs either a court order approving such a move with the children or the consent of the other parent.
