Legal Question in Family Law in New Jersey
divorce and custody rights
i have been separated from my wife since the end of january we have 19 month girl, they live in new jersey and i currently live in new york, i don't have representation she has representation and she filed for divorced under the grounds of adultery, i have been served with the divorced papers and responded the next day we are waiting for a court date. also prior to being served we agreed on a property settlement document, so there is nothing else to dispute although visitation rights were not in the document it was just an agreement between us two, once a week and every other weekend I get the baby. right now she is not letting me see the baby because she found out that i went out with the baby and a friend (woman) and her two kids out to the park, nothing else, so she got very upset and said that i should not introduce the baby to anyone that i am not going to settle with. also she will not let me take her over night when is my weekend. can she do that? what are my rights? since I have agreed to everything she stated on the property settlement, do i need to worry about any surprises when we go to court.?

Re: divorce and custody rights
Any time you walk into a Court Room in a divorce setting you should be concerned about surprises. However, if your agreement has been signed there should be no changes at the time of the divorce hearing. I would strongly suggest that you retain an attorney to represent you at the hearing. I would suggest that you retain counsel to protect your interests and to ensure that your are not giving up valuable rights. In addition, custody and visitation need be addressed.
