my daughter has been married for almost 9 years her husband recently won 1 million dollars in the lottery and wants to divorce her and is having an affair they have two daughters and they own a home he wants to leave her with nothing she is epiletic and has a heart condition please advise us on what to do

Under New Jersey law, marital property in a divorce is subject to equitable distribution. From the limited facts presented, it appears that your daughter is entitled to half of the lottery winnings. She could file for divorce and file an emergent motion to freeze the assets, including the lottery winnings.

The other issues, like child support can be resolved in the divorce.

It is arguable that the lottery winnning are half hers because he presumably purchased the ticket with marital assets. Your daughter should contact an attorney quickly.

Your daughter is entitled to half of the lottery winnings and support for the children. If she waits the money may be spent.
