Re: Divorce & Lottery Winnings
Under New Jersey law, marital property in a divorce is subject to equitable distribution. From the limited facts presented, it appears that your daughter is entitled to half of the lottery winnings. She could file for divorce and file an emergent motion to freeze the assets, including the lottery winnings.
The other issues, like child support can be resolved in the divorce.
I would be happy to follow up. Please email or call for an appointment if you are interested.
equitable distribution of lottery winnings
It is arguable that the lottery winnning are half hers because he presumably purchased the ticket with marital assets. Your daughter should contact an attorney quickly.
