Legal Question in Family Law in New Jersey
the divorce decree on 2-9-09 states we both are listed on the deed to the home. They state she gets to live in the home for 3 yrs whcich at that time she has to buy mr out or sell the home. If my ex moves out of the home in the near future and does not stay there for three years will they house then become soley mine and can i sue her for not following the divorce decree.

No, you will not automatically own it.
You should talk to a lawyer and get some advice.
You will not automatically own the house because the court has determined that she has to buy you out, reflecting her joint ownership with you. The house either must be sold or you will have to buy her out. The time to buy her out is before the housing values return to where they were in a year or two.
