Legal Question in Family Law in New Jersey
Divorce / Embezzlement
I am in the process of getting a divorce. I woke up one day and found I was in large credit card debt from my wife. She charges me with cruelty. She has been embezzling money for a number of years. Is it wise for me to mention this to the judge? Thank you!!!

Re: Divorce / Embezzlement
It all depends on how she did it. Spouses have a claim of right to all joint funds. However, if you guys seperated it is a different story. She also cannot forge your name on any documents. It sounds like you don't have an attorney. I suggest speaking with a couple just to get an idea of what you are looking facing. My consultations are always free so call me at 732/247/3340 and we can discuss your case.
Good luck!

Please, please get an attorney. Yes, credit card debt is very important in the divorce process. She will come up with lots of excuses, reasons why she had to spend the money, etc. Get a lawyer!!!

Re: Divorce / Embezzlement
I find it odd that you would ask such a question, unless you have no attorney. Credit card debt and hidden assets are major parts of a divorce.
She is accountable for funds which she "embezzled" and credit card debt
acquired during the marriage is also her liability.
I would hope that you own a home or some other valuable asset acquired during the marriage which would be the
source of obtaining compensation for funds hidden by your wife in that you would receive from her equity in the marital estate half of whatever she took.
Call me if you like.
