Legal Question in Family Law in New Jersey

Divorce finalized in 1/2006, discovery included pension, IRA acct. (QDRO completed IRA only) all other assets etc... Pension ignored due by ex. (possibly due to 8 mth contribution at 50% exposure for marital coveture) Found out ex. still listed as beneficiary. Want to pay her out of pocket to resolve. Is QDRO needed for this ? Pension never referenced by ex. although all pertinent documents provided.

I wouldn't do anything without an attorney. If you had an attorney for the divorce, that attorney should be able to help you. Otherwise, I'd be happy to help you. Call me at 732/773/2768 to discuss.

You and your ex can do whatever you agree to do. Having said that, I would have to see the final divorce agreement to make sure it was not addressed in some manner. Even if it is not, you should memorialize whatever agreement you come to as part of an amended or supplemental property settlement agreement. Please contact my office to schedule a consultation. Mention Law Guru and I will waive the consultation fee. My telephone number is 732-663-1500.
