Legal Question in Family Law in New Jersey

A friend of mine has been living in a loveless marriage for two years, living in his own room for over that time. He got her a card for their anniversary, she said she forgot and didn't get anything. They don't eat together, he cooks for himself, cleans for himself, laundry, etc. What grounds for divorce does he have. Is this classified abuse? Can he go in that way? What would you suggest. Thank you

The issue is not whether he can get a divorce, but why he hasn't already. NJ, for quite sometime, has had "irreconcilable differences". If a person can say that he (or she) and spouse have not been getting along for longer than 6 months and there is no prospect for reconciliation, then you have grounds for divorce. That does not resolve all of the collateral issues (child issues, equitable distribution, support, etc.), but it gives the person the grounds for divorce. I would suggest that he seek the advice of an attorney as soon as possible to move on with his life.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other facts that would change my opinion. NJ now has "Irreconcilable differences" as a no-fault grounds for divorce, which would apply in this situation. We provide a free initial consultation if he wishes to pursue this further.
