Divorce and house Deed transfer
I'm in the process of divorce, and the marital home will be transferred to my name from a joint ownership with the ex-husband.
I need to clarify some questions on how the house deed is transferred. Please indicate your answers below:
- What kind of deed to use? Quitclaim, or Bargain and Sales? Which one will give more guarantee of ownership?
- Who should execute the deed? Ex-husband or I?
- Who needs to sign on it?
- Who prepares the deed? His attorney, my attorney, or do-it-yourself?

Your Judgment of Divorce or Property Settlement Agreement should state the type of deed. Your divorce attorney should be able to answer the rest of your questions, and tell you how to complete the process.

We are talking about transferring title to a house, aren't we? You can do it yourself if you like and then you can sue yourself for malpractice if you screw things up. How should you prepare and execute the deed? By hiring an attorney.
