Legal Question in Family Law in New Jersey

I'm getting a divorce, my husband left the house which is in his name, he wants to give the house back to the bank he says due to financial hardship (he's on a mortgage modification program). Do I have a legal right to stay until I can find my own place to live?

Well you have to go to court to enforce your right to stay there and get him to pay to keep the house from getting taken over from the bank. There are two different issues here, 1) your right to force him to keep the house afloat and 2) your right to keep the bank from kicking you out. I suggest you get a divorce lawyer ASAP and get moving on this.

You should consider what economic reality is. If he is unable to sustain the house, it really will not matter what your preference is.
