Legal Question in Family Law in New Jersey

I want to divorce my husband of 33 years because of his alcoholism. The only thing I want from him is half of our house which is already paid and alimony. I am 58 years old and the only income I receive is from Social Security Disability because of a cancer diagnosis. I need to use the money from the sale of our house to find a place for me to live. My husband won't sell the house. How is alimony figured out? What do I do?

I am sorry to hear about your troubles. The answer to your question is much more detailed than that which can be given in this format. Alimony is based on a number of factors that are outlined in the Statute and determinations are very fact sensitive. A careful analysis of your situation must be completed before this answer can be given. An application can also be made for the sale of the house if your husband is unwilling or unable to buy out your interest.

Keep in mind that this answer is given based on the scanty information you have provided. My answer may change based on other information. Further, you cannot rely on this answer since you have not retained me as your attorney. To be sure that you have accurate information and direction, you should consult with an attorney. a court will generally order the house to be sold and if your husband does not comply with the court order the court mayappoint someone to sign for him. as to alimony this is not simple and ananalysis must be performed before a concrete answer can be obtained.
