Legal Question in Family Law in New Jersey
Divorce Judgement
Our uncontested divorce was final two years ago....In the settlement, my ex was to pay off my car loan ( which is in my name). He has sent back the loan book stating that he is not going to pay. His reasoning is that he didn't agree to pay for 60 mos. the book was in his hands and payments were being made well before the divorce was final, payment due is the 39th!!! He is also now claiming that there are still items that belong to him here that he now wants? He was asked if he would come and go thru things that he might want, my answer was all I want are the tools from the barn(which he did get). In the agreement I put I get the house and contents. What recourse do I have in this matter? He isn't working but is capable of. Pulling navy pension and wife of two years is working. Thanking you in advance!!!

Re: Divorce Judgement
If the terms you state in your question were made part of the Judgment of Divorce then you may make a motion to enforce the order of the court. That means that you ask the judge to make your ex do what he has agreed or been ordered to do. Under normal circumstances, the Agreement would be make part of the judgment of divorce and would be enforcable by you. I would really need to review your Agreement and the Final Judgement of Divorce in order to more fully advise you. If I can be of further assistance, you may call my office at (201) 641-1605.
