How do you divorce someone you cannot locate and how long does it take?

Divorce from spouse that cannot be located

There is a procedure that would allow you to notify him/her at the last known address and/or advertising in a newspaper of general circulation, assuming certain prerequisites are met. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail, since this procedure can get complicated. I have access to a website which is restricted to attorneys and law enforcement by which I find lost spouses all the time. All I need is the person's name and last known address.

If your spouse can not be found, the procedure is to file a complaint for divorce with the Court

and to obtain a special order authorizing service of the complaint and summons by publication in the official newpaper of the county where you live.

I can probably locate your spouse in fifteen minutes.

I have looked at the responses from the two other attorneys, and they are correct. You will be able to get a divorce a lot more quickly and easily if you use an attorney. I suggest you choose the nearest one. I am near Paterson. 973 890 0400
