my parents are getting divorced after 30yrs of marriage. They separated over 10 years ago because he was deported back to Colombia s.a My father remarried abt. 5yrs ago, in colombia, still being married to my mother in colombia. Now my mother decided to get a divorce. When he was served by the lawyer to sign the divorce papers he refused and said he wants half of what she owns. a house in u.s and an apt in colombia. What are her options?? what can she do?

He could indeed fight her. He will have to come here to do it, certainly, as to assets located in New Jersey.
And she is fully able to fight back, showing the Court that he has been gone for 10 years and has not put a dime into the things that he now wants to take half of.
How long since the youngest child graduated college? Does the husband owe money for Child Support and college? now is the time to pursue that, not after the divorce.
Does she have an attorney? If the attorney can not answer these questions, she should fire that lawyer and hire someone who can. That is the attorney's job.
If she does not have an attorney, she should hire an attorney immediately.

In a divorce everything acquired during the marriage, except for inheritance; items acquired to the marriage and gifts, is subject to distribution between the parties. The question is when the marriage factually ended. It could be argued that it ended ten years ago because the parties have not lived as husband and wife since that time. Maybe not.
