Divorce Petition
We have been married for 11 years and have one 8 yr old sweet daughter. We are having issues right from the first few years of our marriage, since we fundamentally disagree on many things. This led to a stalemate situations at least couple of times every year. We came short of divorce solutions few times, but always continued for the sake of our only child thinking a miracle might happen and change our lives. We tried so many options but nothing worked for us and on the contrary some of them worked against us.
Now I am hopeless because day to day activity is causing more pain and unpleasantness in my family more so to my daughter. Hence I want to go ahead and file a petition independently to end this marriage.
Can I file based on Uncontested - Irreconcilable Differences independently (without my wife�s consent) in the local court (Morris county, New Jersey) as the first step. Please let me know if the forms provided are sufficient to take care of this scenario stated above and if yes which form is best suited for my case.

From what you have said, it seems very likely that you are going to have to start a divorce. You need to solve some problems in your life and your children's lives, and a divorce is pretty much needed; that is what I understand that you are saying.
Employment, income to pay the family's expenses, is an issue.
You have a child: custody and vistation, and child support are issues.
Child support and college tuition needs to be paid. Measured in tens of thousand of dollars.
You probably have a house and some money saved. You probably have a pension plan; maybe your spouse has a pension plan.
You need to see a decent, experienced divorce attorney located reasonably near you, and have the attorney to review your situation carefully with you, and give you some guidance.
A good attorney could save you thousands of dollars and a great deal of heartache, make your life more manageable, and reduce the harm to the child. When choosing an attorney, make sure it is someone whose personality works for you, someone you can work with.

You should call an attorney to help you with this especially due to the length of the marriage and your child. It is too important to try it on your own. Call some attorneys before you decide you can't afford one. If it comes down to it, call legal services.

YOu can go to the courthouse and pick up forms to file for divorce, but if you have any marital assets, a long marriage or dependent children you are bound to screw up your divorce and once you do this to yourself no one can undo the damage. Hire an attorney.
