Divorce proceedings

I am on H1 visa and got married in India a month back. My spouse and I are having marital problems, lack of understanding and differences about general issues. We would like to consider mutual divorce. Can I file for divorce in NJ(and not in India)-where we both stay and how much minimum time will it take to get through (we do not have any disagreement over property/assets). Can you also give a rough estimate about the costs involved?

I do NOT handle immigration issues, but I am sure that if your spouse is now sponsoring you for a greencard, that will be affected if not terminated by a divorce. As far as getting a divorce, it is fairly straightforward. It will take less time (and attorney's fees) if your spouse will cooperate. However, you have a problem: you must reside in NJ for a year in order, in most circumstances, to get a divorce in NJ. There are some other requirements as well. I would need a good deal more information to give you a detailed answer. As to time: three to four months minimum if there are no legal holdups, but I do not know for you. Attorney's fees depends on how much time the lawyer has to spend, and varies wildly. Please call if I can assist; I am in northern NJ. 973 890 0400

You must live in New Jersey in order for a court in this state to have jurisdiction to terminate or annul your marriage.

If the matter is truly uncontested the fee will be $1,500.00 plus court fees of $250.00.
