divorce, property and children
My husband won't help pay the mortgage, n meets women outside our marriage. I just had a new baby 1 month ago and we have a 3 yr. old. I'm going to divorce him for sure...but will I b able to keep my house for my children? I also don't want him to take my children w/ him for visits, he is irresponsible and has a bad addiction to marijuana. I just really want child support, my house and him out of it. Do you think the judge will grant this?

You have a child (children) with this person. Each child needs to be raised, in a decent apartment or house, needs to be fed, clothed, educated, sent to college maybe, and in general supported and loved. You can do the last part on your own (every kid deserves two loving supporting parents, though), but everything else takes MONEY! Money which we will attempt to get from the child's father.
You need advice from a lawyer. Be prepared to pay for the lawyer's time; it is how the lawyer pays for his/her own bills.

You are asking a lot of questions that cannot be answered with the limited information you have provided. New Jersey is an equitable distribution state, and without more information, I cannot provide an answer regarding the home. However, if you are the parent of primary residence you are entitled to receive child support.
