Legal Question in Family Law in New Jersey

divorce, seperation

I have been seperated 17 yrs. Lived together for only 4-5 yrs.

Filing for divorce, wanted to know if she is entitled to my pension I had started at age 17, 50 yrs old now.

Is she entitled to alimony?

Do I have anything to loose here by filing? She said she is going to make this difficult for me. One child 18 yrs old, dropped out of school at 16yrs old.

How hard can she make this for me?

Thanks for your time

Re: divorce, seperation

You are entitled to a no fault divorce based on 18 months of separation. She is not entitled to what was earned when you were not living as husband and wife. She might be entitled to one of half of that portion of your pension which you accrued while living with her.

Call me if you like.
