Legal Question in Family Law in New Jersey
divorce
My son is in the USMC, his legal home state is NJ. About two years ago he married a girl also from NJ but the wedding took place in SC (where he is stationned). He remaind in barracks and she stayed with her parents in NJ. They saw each other infrequently when he had leave. She now wants a divorce. What are his options as far as an anulment is concerened and if that isn't an option which state law applies here (SC becouse the wedding was there or NJ because both are NJ residents).

Re: divorce
A divorce is obtained where you reside
not where you were married.

Re: divorce
You have not provided enough facts to determine whether a civil annulment can be sought and they are given in only limited situations.
But the likelihood is that New Jersey would be the state for the action to be brought.

Re: divorce
I can not answer your question based just on the info you gave. I see that you are not from NJ; if you would like me to assist your son, please have him call me. She can probably file for a divorce here in New Jersey. However, that does not answer a lot of questions.
Your son needs some advice from a lawyer. Please have him call me; I never charge for the first phone call. And for a Marine, I would be happy to assist!
