Legal Question in Family Law in New Jersey

I would like to get a divorce as soon as possible. The divorce is uncontested. My wife and I have been seperated in two different residences for 20 months, we have a 4 yeard old, we own 2 homes and a business. We have had a 50/50 Shared Custody in place for about 32 months. Neither of us is looking for alimony, child support, etc. We basically want to get a divorce as soon as possible.

Is this possible or do we still have to go through the entire process of documenting all financials, assets, etc?

It is certainly possible for the two of you to enter into a Property Settlement Agreement that indicates all of the issues and the manner in which the two of you have resolved them. After signing same, the divorce can be quickly granted. In order to get this done smoothly, you should retain the services of an attorney.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. Feel free to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner

Depending on the county in which you reside a divorce can be obtained in as little as 60 days. You should retain the services of an attorney to discuss what needs to take place.

The less conflict you have the easier it will be to get the divorce accomplished. The fact that you have a working Shared Parenting Plan is a big plus; you still need to similarly address the financial side as well. If you have it worked out that is great but it needs to be reduced to a writing.

An experienced family lawyer can guide you through what needs to be done and file for your divorce.

Please call for an appointment if you are interested in discussing your matter further with one of our attorneys.

You can get a divorce a lot quicker, cheaper and less grief if you and she cooperate. Much easier.

Now, I see that you list your zip code as New York. I would need to discuss this with you, and get a lot more information to be able to assist you.

Please keep in mind that my response is just a general comment on your question, and not legal advice. I have answered based upon the law of the State of New Jersey where I practice; the laws in other states may be very different, and may result in very different outcomes. Your question and any response does NOT create an attorney-client relationship between you and this law firm. The exact details of your situation and things that you have not mentioned in your question can completely change the response I gave. You can not rely upon what I have written as legal advice, because I do not have all of the information that I need to advise you, I only have the very small amount of information that you put into your question. To get legal advice that you can rely on and use, please contact me directly.
