divorce help

i want to divorce my wife. we have

never seen eye to eye and i hope

that it worked its self out. we been

together for 10 yaers and married for

3.i am willing to give her the house

and contents. we have a joint bank

account for bills and our personal

accounts seperate.will my personal

accounts be looked into? will i have

to split it if we get separated? I also

have 2 rental properties that i would

like to keep. she can keep the

primary residence but i just dont

wanna get screwed. i have worked

very hard to get were i am at and

she has not supported me in any

way wether financial or mentally. i

just dont want to abondon

everything. also i leave the house

will i get pentalized for that? thanks

New Jersey is an equitable distribution state, meaning that all the assets of the marriage and all the debt get divided equally. If you have premarital property, that might be exempt from distribution. You can leave the home without a penality, however, I would suggest you seek the services of an attorney to put together a plan of action before you leave.

All property acquired during a marriage, excluding gifts and inheritance, is split on a 50/50 basis, normally.

I suggest you meet with a lawyer as you have some important issues going on here. You can leave the house without any penalty. Keep in mind that 98% of divorces settle. Thus, you don't "have" to do anything. You can settle the case in any way you would like. If you would like to give her the house and contents and you keep the rest, then you "can" do that. However, it takes two to make an agreement and if she is not on board, your not going to get far.
