Legal Question in Family Law in New Jersey

divorce

my wife filed for a divorce 9 months ago. i found out that she is three months pregnant from someone else. the divorce has not been finalized because i did not sign the papers. I pay alimony nad child support. She wants half of what i have and is going after my pension. WE were married for 6 years only. how will her being pregnant from another man affect the divorce and what she wants.

You should have an attorney for your divorce and should be asking him these questions. She is entitled to one half of whatever you acquired during the marriage and you have the same rights as to her assets. She gets one third of the pension value earned during the marriage if she gets that now and one half of the pension value earned during the marriage if she waits for your retirement.

Her infidelity does not impact on the financial issues of a divorce, but it may relate to the legal duration of your marriage. I would say that whenever

she began to have sexual relations with the father of the child she is carrying might be deemed an indication of the factual end of your marriage.

If you do not have a divorce attorney working for you, you should hire one today. Today.

If you do have a divorce attorney working for you, and you have asked these very reasonable questions without a good answer, then fire that attorney and hire another one.

She gets 'equitable distribution'. This often means, but not always, splitting assets 50/50. You need to talk to a lawyer to get some answers.

I agree with the other attorneys. Where is your attorney in all this? If alimony is on the table, you do have enough to pay one.
