Considering Divorce- Have a five year old son
I'm considering a divorce. My husband doesn't treat me very well (not abusive, just not nice), is non-communicative, dominating,etc. and rarely allows me to see my family. He'll give me the silent treatment for a week if he doesn't think the house is clean enough.
He loves his son as I do and is a good father. I'm a stay at home mom and work full time from home. I'll earn between $20,000 & $30,000 per year as a freelance writer, but can earn more if I work more hours.
If I do divorce him, I'd want to move closer to my family. There's nothing for me here in this town. It's closer to his family not mine. Our son is just entering kindergarten so he's not too established in the community.
If I separated from my husband, would I be able to take my son with me to another state (about 3 hours from my husband). What rights to do I have? My son is the only thing keeping me in this marriage.

Unless he consents, you need to file a motion with the court to allow you to move to another state. If you are considering divorce, I suggest that you consult with attorney before doing anything. Many attorneys, such as myself, have free consultations.
