Legal Question in Family Law in New Jersey

If I got divorced a couple of years ago, and my ex still carries my last name because of our daughter, can I file for her to change her last name because I am getting remarried and want my ex to release the last name from hers. Is it possible to file for this?

Your question implies that your new wife cannot have the same last name as you unless your ex-wife "releases" it. Where did you get that idea? Names are not proprietary or exclusive. Just ask anyone named "Smith", "Brown" or "Jones". Get married and be happy!
