Divorced Father Of 2 Boys
I am a Divorced Father with my Son and Stepson living with me. I have been their main financial supporter for most of their lives. There has been no court order on Custody, but both Sons are on my lease, as well as my youngest son registered for school at my house. There mother lives in a situation where she can not keep them, nor have them over night. Do I need to file for custody of my son to make sure she can't just up and get him one day and try and keep him. Or am I legally the Custodial parent seeing as they both live with me. If I do have to file for custody, do I have to have her involved?

You should file a custody complaint to
protect against the mother showing up unannounced and taking her child.

I agree with Mr. Moore. File the motion. Otherwise, you are in limbo and I doubt the police will want to get involved. You may not need an attorney, but it will not hurt if you see one.
