Legal Question in Family Law in New Jersey

I have been divorced for 10 years. My divorce decree says my husband and I will each pay 50% of tuition for our kids. His income has gone down by about 25% since the divorce. He now wants me to pay more than 50% of the kids tuition since at this point in time I make more money than he does. He has had ten years to save for the college tuition but saved very little. Can a judge change the agreement from our divorce decree at this point in time and make me pay a larger share of their tuition.

It is possible. I can see the arguments from both sides. Thus, I suggest you get an attorney to help you with this.

You should fight him on this. Ten years later and NOW he wants to cry poverty? Was your divorce in Morris County Courthouse? Many of the divorce judges there are just terrific, and will give you a fair hearing. If he will not pay, you will have to take action.
