Legal Question in Family Law in New Jersey
Hi, i'm divorced 2 years now, at divorce i gave my ex the condo to alleviate alimony, the deed is not in my name, but the mortgage still is because she was unable to refinance in her name. The terms were that she has up to 8 years till my son turns 18 to refinance in her name or sell. Also , we are not supposed to affect each other's credit, she has been on time until recently with the mortgage, it affected my credit, i was already suffering bad credit from divorce to begin with. My lawyer told me there is no way she will be able to refinance because of her income, he said maybe force her to sell, but the mortgage is much higher than the home is valued at.What are my options? please help

Please keep in mind that my response is just a general comment on your question, and not legal advice. I have answered based upon the law of the State of New Jersey where I practice; the laws in other states may be very different, and may result in very different outcomes. Your question and any response does NOT create an attorney-client relationship between you and this law firm. The exact details of your situation and things that you have not mentioned in your question can completely change the response I gave. You can not rely upon what I have written as legal advice, because I do not have all of the information that I need to advise you, I only have the very small amount of information that you put into your question.
