Legal Question in Family Law in New Jersey

Divorcing an Alcoholic

I'm in the process of divorcing an alcoholic, who nearly died from his addiction 4 years ago. He has been to rehab and even moved to Florida for 4 months to live in a rehab center with other addicts. However, he continues to drink to this day. My question is ... can I request that he go into treatment for his addiction (and prove his sobriety) before allowing him parenting time with our 7 year old daughter? He has already agreed to give me sole custody.

Once you establish his past, chronic alcoholism you should be able to get the Court to place efforts at rehabilitation as a condition of visitation with your child.

Yes, you can, but there's a few things you will have to prove before a court goes along with it. Call my office to discuss your case in more detail. My initial consultations are always free.
