Legal Question in Family Law in New Jersey
dna swab buccal testing (motherless)
In your legal experience, how accurate are the results of a dna swab buccal test w/the alleged father & the infant, no mother ? Are the results usually reliable or as a divorce proceeding goes on, is test viewed as flawed ?

I am somewhat puzzled by your question. First of all, every human being, who is not a clone, has a mother. Secondly, I do not understand the distinction between the dna a swab might detect or that which analysis of hair or other bodily material might produce. Dna analysis is deemed to be 99 % reliable.

It totally depends on the facts of the case and the results of the test. A DNA test cannot say that there is a 100% certainty that this person matches with this DNA, i.e. is the suspect, is the father, etc. It can only give the odds and/or percentage. In one case, we had a client who they thought was the father but he had a brother and his brother came up as with a higher percentage than the client. It was something like 96.6% for my client, and 97.1% for the brother. So, it was too close to call either way and no one was deemed the father. I suggest you at least meet with an attorney to discuss your situation. My initial consultations are always free, so you can call me at 732/247/3340 if you'd like.
Good luck!
