domestic assault

what should i expect to happen when we appear before the judge. should i get a lawyer,will there be a district attorney in her behalf.can the sentence me to jail. Or extend the TRO. and I remain in the streets.and not in my apartment

If you have a hearing on a domestic violence complaint as to whether a temporary restraining should be made permanent, there would be no possibility of a jail sentence and no prosecutor would participate in the hearing. If you are having hearing on a criminal charge of assault there will be a prosecutor and you could go to jail. In either event you need and attorney.

Dear Sir:

You need a lawyer. Immediately. I have defended domestic violence charges for many years: you must get a lawyer, to give yourself the best chance to deal with this.

You are not facing jail if this is only a domestic violence matter. But you may be kept out of your apartment and have other bad things happen.

You are facing jail on the criminal assualt charge, if there is one pending.

In any case, get a lawyer.

You are likely to be more successful with an attorney representing you.
