Legal Question in Family Law in New Jersey
Domestic Violence Conviction
What type of offense is DV? If found guilty of DV, what type of police/criminal record a person would have?
No evidence of any physical harm and no arrest and/or jail, just a fine of $50. Emails sent to the so called victim were sufficient for the court to ruled DV. The emails did not contain any thread whatsoever.

Re: Domestic Violence Conviction
a domestic violence conviction is very much something you want to avoid if possible.
You really and truly need an attorney to help you, someone who is familiar with divorce law (this is a divorce type issue) and criminal law.
You would be very foolish to do this without expert assistance. The consequences of a DV conviction can be very serious.

Re: Domestic Violence Conviction
Domestic violence is a hybrid legal animal. It is based on the commision of a criminal offense, but has a standard of proof based on the civil standard of proof by the preponderance of the evidence, more than 50% likely, instead of the criminal standard of proof beyond a reasonable doubt.
The consequences of a determination of the commission of an act of domestic violence included having your name placed in a special domestic violence registry. A finding of domestic violence has the additional consequence of barring the person from carrying a firearm, A member of the military or a policeman would be greately effected by a finding of domestic violence.
What can you do about the charge? Hire a good lawyer. I am a good lawyer.
Call me if you like.
