Domestic violence

My husband is abbusive, just last month he threated to kill me. The police have been to our house several times, and they have taken police reports. I want to move and leave the state and take my 9 year old daughter with me without telling my husband, because I am affraid of what he might do to us. We own a 1 family house. My questions are, if I leave the state without telling him would I be in trouble, will the law consider that kidnapping? And once I leave I would like to file for divorce, should I start the process before I leave the state of New Jersey?

You need to file for removal in NJ. I suggest you get an attorney to help you make sure everything is done right. You may also want to file for a TRO if he is threatening you.
