domestic violence or not?

after months of horrible mental abuse can i file a restraining order against my husband for leaving the state of nj with his girlfriend for a week. he lied to his son, his work place about his location. he refuses to leave the marital home although he has a girlfriend. divorce has been filed in dec. would this be abandonment considering last week he refused to pay child care because he was going to pick up and drop off our child at school. something he has not done since the child was born.
