Legal Question in Family Law in New Jersey

Dro pension distribution

my ex husband was to have a QDRO entered at the time of our divorce, which entitled me to aportion of his pension. He did not.

I had a QDRO prepared and signed and submitted to his penaion adm. I am now getting my portion of the pension. Can I sue my ex husband for the 33 months he collected my share? Can I sue in the county I now reside?

Re: Dro pension distribution

I would think that you should file a motion under the action for divorce in which a judgment was entered, requesting an Order entering a judgment for the total amount of payments of which you were deprived; the cost of the QDRO which you paid.

Call me if you like.
