Legal Question in Family Law in New Jersey

Regarding DV Complaint

in charge 2C:12-1A if I can not obtain an attorney for the hearing of this evening, can I ask for a postponement to seek counsel? Husband has counsel for his simple assault charges that were filed the evening it occured on 1/25, when I received my TRO. Counsel for the TRO hearing but not for the criminal hearing that is scheduled for this evening and I am not sure how to proceed. I have pictures and the police department took pictures as well as my step mom, step mom will come with me tonight as witness and my 14 yr old. Will they let 14 yr old testify? She called 911 she saw everything accurately. and has had equal parenting time since the incident. Your thoughts? Greatly appreciated.

Re: Regarding DV Complaint

If this is your first appearance in court on this charge, there should be no problem getting an adjournment in order to hire an attorney. You should subpoena the police for the final hearing. Calling your daughter is permitted but should be a last resort since it puts her in a difficult spot.
