Dyfs

My children have been removed by dyfs. The reason was b/c they claimed I violated a plan stating I would not allow my husband to be alone with the kids. Dyfs has an open case because of my husbands drug problem.

My question is this:

The only reason I signed the plan was dyfs said if I did not then the kids would be removed. I have left my husband, I am not under ivestigation, do not use drugs, am hard working etc. Can the court refuse to return my kids to me, b/c my husband has the issues? I have since moved out and have no issues except for the case plan they claim i violated.

DYFS can remove the children if you violated a court order. You need to immediately obtain the services of an attorney, and file a motion with the court to have the children returned to you. Do not wait or dely, and be able to show that no harm occured with the one violation, and that you have taken steps to make sure it will not occur again.

One of the problems is, you signed the order and then you violated it. Even if they lied to you, you still violated the agreement. Now, you are going to need an attorney to undo all of this.
