Emancipation of an Adult Child with an Extra Y chromosome
I was brutally attacked by a 23-24 hold man 3 years ago. My son which is his biological son was also abused by this man. The attack took place in his parents home. His parents have known of his x-tra ''y'' chromosome since he was 9. They were aware of his violent tendancies and him not taking his med's and allowed him to live in their home, knowing of the risk. I filed a civil suit vs. the parents and the violator. I feel the parents are responsible because they knew the risk when they allowed him to live in their home. Wouldn't this fall under the failure to emancipate, as any reasonable parent who considered to allow their adult child with an extra ''y'' chromosome would know to check before allowing their adult child to live in their home? Had they checked, they would have learned that if they filed an emancipation from their child, they would not longer be responsible for his acts. These people knew what was wrong with their son and did nothing about it. The parents have filed a summary judgment and was hoping I can use this strategy.

I do not believe there is a reasonable basis for a claim against the parents. I suggest that you consult with another attorney. Another lawyer may see the case differently.
