emancipation

can i do an emancipation without an attorney. is their some kind of kit available and where do i get one?

You can try to obtain an Order of Emancipation on your own, but it may be tough. There is no "kit". Like anything else, if you are able to do something on your own, you do it. If you can't, you hire someone. It is up to you to prove that your child is emancipated. This can be accomplished by proof to the Judge in any number of ways. The best way, however, is just to file a Motion and state in your Affidavit his/her date of birth and then the facts and circumstances concerning why you believe he/she is emancipated. If the motion is ignored, you may win by default. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail.
