Emancipation of child
When is a child considered emancipated and therefore not eligible for child support. My oldest will be 18 in jan and will be going on to college in the fall.

if attending college full time and not working, the child is NOT emancipated. there are some adjustments to child support, depending on circumstances (living at home? at school? other children?) and there is the huge question of college expenses.
you sound like you do not have an attorney to advise you. get one. please. me or someone else. but there is just far too much money that could be lost if you do the wrong thing.
and if you do have an attorney, then you should have been able to ask this question and get an answer. get another attorney.

"Emancipation" is not defined by age, it is defined by status. Thus, if the child is still in school at age 25, he/she may not be emancipated. On the other hand, a child who is married at age 17 would be emancipated. A careful review of all of the facts and circumstances is necessary. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. When your child has completed four years of college he will be emancipated. If he quits college he will be emancipated.
