Legal Question in Family Law in New Jersey

Emancipation

I am divorced and have 2 daughters ages 7 and 21 living with my ex wife. My exwife is asking the court to make me pay support and college expenses for the 21 year old daughter. She has been living with her boyfriend in the basement of my ex wife's home for 2 years as husband and wife without being married. He works full time and she goes to college and works. Is there any case law I can cite to support my argument that she is emancipated?

Re: Emancipation

If she were living with him away from your former wife's house or married to him she would would clearly be deemed to be emancipated. I believe that the combination of his working and living with your daughter may be emough to have the court declare her to be emancipated. 800 273 7933
