Legal Question in Family Law in New Jersey

Emancipation

I live in NJ and just found out that my 19yr old estranged son is not and has never been a F/T student. His 1st semester he registered for 12, dropped 3 and then FAILED the remaining 9 credits. The 2nd semester he registered for 12 credits and then withdrew from all of his classes. This coming fall 09 schedule he is registered for 10 credits. My ex wife has received over $6000 in the last year from me knowing full well he is not a F/T student. Can i emancipate him and can I also ask a judge to squash the $900 I am in arrears. They both have told me over the last year he was a passing F/T student. Any insight would be helpful!!!

Thanks

Re: Emancipation

You have to file a motion with the Court to emancipate your son. The only issue I see is that he had registered again for the fall and some judges/courts might allow him a break.

However, if he is only taking 10 credits, he is not considered full time.

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.
