As the other attorneys pretty much said, you need to file a motion for emancipation. If you would like to discuss these issues, please call me at 732/247/3340 as the law has recently changed and the timing of your motion may be very important. My initial consulations are always free.

When he is out of school and self supporting, on his own and eighteen years of age you can APPLY

TO TERMINATE CHILD SUPPORT.

You might call me.

Re: Emancipation of Minor

ok, he is out of high school, no further education. child support does not automatically cut off, you have to get it cut off by the Court.

when he is on his own, emancipated, you ask to stop it.

if he is at home with his mom, not so clear. you could talk to a lawyer now, or you could wait until he is a couple months from age 18. you may get his mother to agree to terminate. you will want that in writing.

If you would like, give me a call; I am in northern New Jersey. I will be happy to discuss this with you; the telephone consultation will be free.
