Emancipation/Part-Time Studen

I currently pay child support for my daughter who resides at my

house and my ex's house every other week (i.e., joint shared

custody). My daughter turned 18 in 10/03 and graduated high

school in 06/04. She currently is NOT enrolled for college and is

possibly going to enroll in a 2 yr. part-time (3 hrs. a day 4 days a

wk.) cosmetology program at a local vocational school. She also

currently works 2 part time jobs . She also purchases all her

clothing and necessities as her mother refuses to give her any of

the support money. In addition, she is thinking about coming and

living w/me full time. Can she be emancipated?

Maybe. This is a close call, in my opinion. Certainly, there is a "substantial change of circumstance" that warrants looking at the entire situation, determining her needs and the rights of the various parties to pay/receive child support. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion.
