Legal Question in Family Law in New Jersey

Emancipation/Termination of Child Support

What is the ''legalese'' reason in a pro se motion to emancipate & terminate child support for an 18 year old who is withdrawn from high school (did not graduate), been intermittently removed from public school and the custodial parent's home for violent behavior, placed in foster care, then placed back in the custodial parent's home under the supervision of a social worker and probation officer; placed in drug rehab facilities multiple times as a juvenile, involved in illegal/controlled drug use; possession with intent to distribute illegal drugs, now facing a felony charge as an adult for a drug offense committed after turning 18 years of age? Am I entitled to a ''refund'' for child support paid during time periods the child did not live with the custodial parent and was in foster care or juvenile detention facilities?

Re: Emancipation/Termination of Child Support

There is no 'legalese'.

I strongly suggest that you contact a divorce attorney who is located in the same county where you got divorced, and get some assistance.

No lawyer can assist with this complex problem over the internet.

On a different topic: your son is a young man in crisis, headed toward disaster.

I have no idea what help you can be to him, or what help you can get him, but I suggest you do everything that you can for this boy. He is in very bad shape.

I agree with Mr. Davies. Many people pay myself and my other lawyers to do what you are looking to do. These people do this not because they like to pay us, but because they know that, overall, it is a good investment. Thus, I strongly suggest you get an attorney. I practice state wide and my initial consultations are free.
