enagement ring given back?
My ex fiance broke off our engagement in october of 06. She lived with me for about 7 months up untill that point. She refuses to give back the ring stating that it was a gift and she does not have to. She also states that while living with me I saved $700/month in child care because she watched my son at times who is not hers. I am a single dad with full custody of my son.
She never paid rent and I had her on my health benefits as a domestic partner and still do at $200/month. I am doing this because I felt bad for her to not have insurance. I pay for it myself. She states I owe her for the down payment on the wedding, her dress, etc. I live in NJ. Does she have to give me the ring back? I would think she does. I have also spent numerous $ on dinners, food, gas, a $300 haircut, a $500 deductible for her car accident(She was not on my insurance either), dental visits, trips. Any info will help.

You are entitled to the return of your engagement ring.

It is a conditional gift and you should get it back.

I will only add that I recently fought for my client in a case like this, in which she wanted the guy to pay back the money he ran up on her credit card but promised to pay. She sued, he counterclaimed asking for every dime he ever spent during their relationship. Just before trial, he backed off, and agreed to pay her most of the money owed on the credit card (he did have some legitimate claims against her but not a lot!)
You can expect a silly 'pay me back for everything' response. You should file suit to get back the ring, despite that.
