Enforce litigant rights
Here we go again.. My 8 mo old child's father (non-dissolution) and I went to court on Jan. 3 to enforce litigants rights for 1) holiday visitaion 2) exposure to smoking and 3) daycare expenses. We had a court order from July 07 that stated he was responsible for 50% of daycare expenses. He did not comply with this and that's why I filed for the Jan 3 hearing. I also filed for supervised visitation which I did not get. He's an angry person with incident reports and an arrest in his past and his family has smoked around the child in the past. He stated on Jan 3 that his family had quit smoking in front of the mediator. I asked for proof with a Dr. note. Th mediator gave him a week to comply and this was signed by a judge. 5 weeks later no note and he came up with a story that it was sent certified but sent back because I didn't pick it up. Then he said Sunday 2/3. I did not get the letter and when I asked for it and told him this was a court order he called me an a**hole and a liar. I have complied with all visitation for this man and I am quite tired of having to go back to court to enforce my rights. Plus his behavior towards me is harrassing and abusive - court didn't care.
